(Alliance News) - Burford Capital Ltd on Monday noted a USD5.7 billion jury award to Taction Technology Ltd in its patent infringement case against Apple Inc, a case which Burford helped to fund.
Taction filed the lawsuit in 2021, alleging that Apple infringed patents relating to haptics technology used in products including the iPhone and Apple Watch.
On Friday, a jury in the US awarded Taction USD5.7 billion in damages. Apple has said it will challenge the verdict.
If the award were paid in full as it stands, Burford's entitlement would be USD1.4 billion, split roughly equally between its balance sheet and investment funds.
Burford is the London- and New York-based litigation financing provider. It cautioned that the verdict is not a final judgement and is likely to be altered in post-trial and appellate proceedings.
Burford said the case remains subject to significant litigation and collection risks, including enforcement and potential collateral litigation in other jurisdictions. It noted that very few large patent verdicts survive the post-verdict process intact.
Burford said its ultimate entitlement, if any, will also depend on the terms of its financing agreement and applicable fees, expenses, taxes and other deductions. It said it could ultimately recover substantially less than USD1.4 billion or, in certain circumstances, incur a total loss.
Shares in Burford Capital were up 4.9% at 289.60 pence per share on Monday morning in London for a market capitalisation of GBP632.0 million.
