Emmerson PLC - developer of the Khemisset potash mine in Morocco - Says tribunal has, following a hearing in June, rejected Morocco's application from May to have certain jurisdictional objections bifurcated, or addressed in a separate, preliminary phase, before evaluating the merits of Emmerson subsidiaries Khemisset UK Ltd and Potasse de Khemisset SA's arbitration claims. The rejection means that the tribunal will address Morocco's objections at the same time as it analyses the merits of the case. Emmerson says the timing of the next steps is yet to be confirmed.
Khemisset and Potasse are seeking USD1.2 million in compensation for the loss and damage they say they sustained due to Morocco breaching its obligations under an agreement between Morocco and the UK.
