Update on U.S. Subsidiary, DataTern, Inc., Patent Litigation
London and New York, 13 April 2011 - DataTern, Inc., a wholly-owned subsidiary of Amphion Innovations plc (AIM: AMP) ("Amphion" or "the Company"), has successfully obtained settlements from suits brought in the U.S. against several, multi-national companies, for enforcement of its U.S. Patents 5,937,402 and 6,101,502 covering Object to Relational Database Mapping technology. Last week, Microsoft Corporation (NASD: MSFT) brought suit against DataTern claiming these patents are not infringed by Microsoft technology and are invalid. DataTerrn will strongly refute these claims by Microsoft and continue to enforce these patents against other infringers.
These patents are entitled to a presumption of validity and the 6,101,502 patent successfully completed a re-examination procedure in the U.S. Patent and Trademark Office in 2009. All 18 claims of this patent were reaffirmed and 26 new claims were added.
Richard Morgan, CEO of Amphion, said:
