Bank Pekao SA04 March 2008 UNOFFICIAL TRANSLATION 4th of March, 2008 Report 28/2008: Submission of complaints against decisions of court officialdated on November 28, 2007 and on November 30, 2007 The management Board of Bank Polska Kasa Opieki S.A. ("Bank") informs that onMarch 3, 2008, the Bank received: (i) complaint filed by the Bank's shareholder against decision of court officialdated on November 28, 2007 regarding increase of the Bank's share capital as aacquiring company of separation part of assets of Bank BPH S.A. (division byseparation) and (ii) complaint filed by the Bank's shareholder against decision of courtofficial dated on November 30, 2007 regarding the supplement of the decisiondated on November 28, 2007. In the Bank's opinion the both complaints are groundless. Legal basis: Section 39, Subsection 1, Clause 6 of the Ordinance of the Ministerof Finance on Current and Periodical Information Submitted by the Issuers ofSecurities of 19 October 2005.
