Bank of America Corporation Issue of up to EUR 50,000,000 Floored Floating Rate Notes due September 2015 under the U.S. $65,000,000,000 Bank of America Corporation Euro Medium-Term Note Program

We refer to the Final Terms dated 5 August 2010 in relation to the Issue of up to EUR 50,000,000 Floored Floating Rate Notes due September 2015 (the "Issue").

Pursuant to our obligations under Article 8 of the Prospectus Directive, we confirm in respect of the Issue that no Notes will be issued and the Issue has been cancelled.
