ERT successfully protects core PIM process patents

Environmental Recycling Technologies plc ("ERT" or "the Company"), which has developed and commercialised the patented rights to the Powder Impression Moulding ("PIM") process which converts mixed waste plastics into commercially viable end products, is pleased to announce that it has successfully defended its core patents.

Today's ruling in the UK Patent County Court confirms ERT's ownership of its core PIM process patents. The ruling successfully brings to close an action brought by ERT against the grant of a patent, which it believed infringed its core PIM process technology. The conclusion of the judgement is that of all the claims made in the defendant's patent, none have been considered innovative or inventive over ERT's patents with the exception of the use of a manually inserted former which, according to highly respected industry expert witness Colin Williamson, is "a crazy solution to a non-existent problem". None of ERT's PIM licensees use this element in their production processes.

Separately, ERT has successfully defended a post grant opposition to its European Patent. At the hearing in Munich, the European Patent Office upheld the validity of ERTs PIM process patent.
