Outcome of Judicial Review
30 July 2012
On 19 July 2012 zamano plc (AIM:ZMNO, ESM:ZAZ), announced that in early June 2012, in conjunction with its co-plaintiffs, Modeva, and the Irish Phone Paid Services Association, it had obtained a stay in the High Court on certain provisions of The Commission for Communications Regulation (ComReg) new Code of Practice which was introduced on 5 June 2012. At a High Court hearing on 25 July 2012, Mr Justice Peter Kelly granted ComReg's application to lift the stay on those provisions of the new Code of Practice which Mr Justice Kevin Cross had stayed on 2 June 2012.
The full provisions of the new Code of Practice will now apply to the Group's premium rate SMS business in Ireland. The Group is currently assessing the impact of the new Code of Practice on its Irish business and is exploring its options in relation to the future operation of this business.
Notwithstanding the lifting by the High Court of the stay in relation to certain provisions of ComReg's new Code of Practice, the Group, along with its co-plaintiffs, is continuing to take Plenary Proceedings against The Commission for Communications Regulation, The Attorney General and the Minister for Communications, Energy and Natural Resources in relation to the introduction of the new Code of Practice.
