MyTravel case against European Commission rejected
Thomas Cook Group plc announces that the European Court has dismissed its claim for damages against the European Commission arising out of the European Commission's decision to prohibit Airtours' proposed acquisition of First Choice in September 1999.
The Court decided that the Commission prohibiting the acquisition of First Choice by MyTravel does not make the Community liable in damages since the Commission did not manifestly and gravely infringe Community law. The Company has two months to decide whether to appeal.
The Company is disappointed with this decision, which insulates the European Commission from the consequences of its wrongful conduct.
The decision will not affect the Thomas Cook group, which had not assumed in its budgets and forecasts that any compensation would be received.
