Office of Fair Trading26 September 2005 REVIEW OF UNDERTAKINGS GIVEN FOLLOWING THE CC REPORT - "FirstGroup plc and theScottish Passenger Rail franchise: A report on the proposed acquisition byFirstGroup plc of the Scottish Passenger Rail franchise currently operated byScotRail Railways Limited". FirstGroup has requested that certain aspects of the above undertakings,accepted by the Competition Commission on 15 October 2004, be reviewed undersection 92(2) of the Enterprise Act 2002 with a view to the variation of theundertakings. The OFT review will consider a number of matters including: • Fare Limits and Base Fare Groups (where there are insufficient comparators) - used to determine the level of restricted fares on certain routes. • The definitions of the Glasgow and Edinburgh regions that are used in the undertakings to ensure consistency with similar definitions used in pre existing undertakings given in the FirstGroup / SB Holdings merger. Following the review the OFT will advise the Competition Commission on whether,the undertakings need to be varied or to be superseded by a new enforcementundertaking.
