SCOTTISH AND SOUTHERN ENERGY PLC

ARTICLE 5(1) OF THE LARGE COMBUSTION PLANT DIRECTIVE

Scottish and Southern Energy plc ("SSE") is applying to the Environment Agency for what should be the final extension of its existing derogations under Article 5 (1) of the Large Combustion Plant Directive, in respect of Fiddler's Ferry and Ferrybridge power stations.

The extension, to 7 January 2009, is to allow SSE to continue to operate the plant opted in to the Directive, while undertaking the hot commissioning of flue gas desulphurisation equipment. SSE continues to expect to do this during December, in line with the timetable set out in its interim results statement on 12 November 2008and is applying for the extension to allow maximum operational flexibility during the process.
