JJB response to CAT

JJB Sports PLC19 May 2005 JJB is disappointed by the judgment of the Competition Appeal Tribunal JJB Sports plc ("JJB"), notes the judgment of the Competition Appeal Tribunal("CAT") regarding the quantum of the penalty assessed upon JJB by the Office ofFair Trading ("OFT") concerning their investigations into the allegedprice-fixing of replica football shirts. Whilst JJB is pleased to note that the CAT has reduced the OFT penalty from £8.4million to £6.7 million, it is disappointed in the amount of the reduction anddoes not believe that it fully reflects the findings made in JJB's favour by theCAT in the main hearing. At that hearing JJB had been found not guilty of someaccusations originally made against it by the OFT and which had been taken intoaccount in their calculation of the £8.4 million penalty. JJB has today made an application to the CAT for leave to appeal to the Court ofAppeal against the CAT's judgments in relation both to important aspects oftheir liability judgment and to the quantum of the penalty.
