 North Atlantic Smaller Companies Investment Trust Plc and Mr C Mills are deemed to be acting in concert by the Takeover Panel. Mr C Mills currently owns 328,716 ordinary shares of the Company and together with North Atlantic Smaller Companies Investment Trust Plc, the combined unchanged holding is 7,435,000 ordinary shares, representing 43.94% of the Company's issued share capital.

Pursuant to the waivers granted by the Takeover Panel and approved by Oryx's shareholders (excluding the Concert Party) at the Company's Annual General Meeting held on 22 August 2013, there is no obligation on the Concert Party to make an offer under Rule 9 or Rule 37 of the City Code on Takeovers and Mergers.
