Fyffes PLC24 July 2007 Stock Exchange Announcement Receipt of Statements of Objections from the European Commission Fyffes plc confirms that the company and its wholly owned subsidiaries FyffesInternational, Fyffes BV and Fyffes Group Limited (together "Fyffes") and itsEuropean joint venture, Internationale Fruchtimport Gesellschaft Weichert & Co.KG ("Weichert"), received Statements of Objections* today, 24 July 2007, fromthe European Commission. The Statements of Objections allege infringements ofArticle 81 of the Treaty of Rome and Article 53 of the European Economic Area(EEA) Agreement relating to the supply of bananas to the Northern Europeanregion of the EEA (Germany, Austria, Belgium, the Netherlands, Luxembourg,Sweden, Finland, Denmark and Norway). The Statements of Objections follow inspections carried out by the EuropeanCommission at the premises of Fyffes and Weichert in early June 2005 andsubsequent requests for information, with which Fyffes has fully complied. Fyffes and Weichert will examine the European Commission's preliminary findingsas reported in the Statements of Objections and respond in due course. * Reference A Statement of Objections is a procedural and preparatory document, intendedsolely for the undertaking against which a procedure is initiated, in relationto an alleged infringement of EC competition law, with a view to enabling themto exercise effectively their right to a fair hearing. Any final decision by the European Commission is subject to appeal to theEuropean Courts.
