Bank Pekao SA19 June 2007 UNOFFICIAL TRANSLATION Report 84/2007: Dismissal of the motion for measure for conservation of a claimfor canceling the resolution no. 5 of the Ordinary Shareholders Meeting of theBank regarding approval of the Bank's financial statement for year 2006 The Management Board of Bank Polska Kasa Opieki S.A. (the "Bank") informs thaton June 18, 2007 the Bank received the statement of the Circuit Court in Warsaw,XX Economical Division of June 11, 2007 on dismissal of the Bank shareholder'smotion for measure for conservation of a claim for canceling the resolution no.5 of the Ordinary Shareholders Meeting of the Bank of April 26, 2007 throughsuspending the registration proceedings conducted in front of the District Countfor the city of Warsaw, XII Economical Division of the National Court Register.Presenting justification for the dismissal of the motion the Court indicatedthat the plaintiff (the applicant) has not demonstrated the existence ofprerequisites enabling possibility of effective protection of claim and moreoverthe manner of conservation of a claim as demanded by the plaintiff is not inconjunction with the proceedings in question. The sentence is not final. The plaintiff (the applicant) has the right to submita complaint to the Court of Appeal in Warsaw within 7 days from the receipt ofthe statement. Simultaneously, we inform that until now the Bank has not received the summonsto cancel the resolution no. 5 of the Ordinary Shareholders Meeting of the Bankof April 26, 2007.
