Dismissal of the claim to overrule the resolutions No. 4, 5, 6, 7, 11, 12, 13, 14, 15, 16, 17, 18, 19, 21, 22, 23, 24, 25, 26, 27, 28, 29, 32 and 33 of the Ordinary Shareholders Meeting of the Bank dated April 23, 2008
Management Board of Bank Polska Kasa Opieki S.A. ("Bank") hereby informs that by judgment of 28 January 2010 the Circuit Court in Warsaw dismissed entirely the claim brought by the Bank's shareholder to overrule the resolutions No 4, 5, 6, 7, 11, 12, 13, 14, 15, 16, 17, 18, 19, 21, 22, 23, 24, 25, 26, 27, 28, 29, 32 and 33 of Ordinary General Meeting of the Bank dated April 23, 2008 concerning approval for the report on the activity of the Management Board for 2007, approval for the financial statements of Bank and Bank Pekao S.A. Capital Group for 2007, approval for the report on the activity of the Supervisory Board in 2007, vote of approval for the present members of the Management and Supervisory Boards for 2007. Simultaneously the Court adjudged the amount 8,640 PLN from the plaintiff to the Bank as costs of representation in proceedings and, in relation to withdrawal of the release from court costs, obligated the plaintiff to pay the amount 48,000 PLN for the Court as the non-effected court fee for the lawsuit.
The aforementioned decision is not yet legally valid.
Legal basis: § 38 section 1 point 6 of the Finance Minister's Ordinance of 19 February 2009 re. current and periodic reports published by the issuers of securities and the rules of equal treatment of the information required by the laws of non-member states.
