Re: Cablevisión S.A. Relevant Event
Martín G. Ríos, in my capacity as Responsible of Market Relations of Cablevisión S.A. (the Company), maintaining the legal domicile at Av. Juana Manso 205, 1st Floor, Autonomous City of Buenos Aires, Tel. 4021 7700, I hereby address the Commission to inform you that today the Company was served notice of a decision rendered in re: "Ombudsman (Defensor del Pueblo) v. Cablevisión S.A. re/ collateral proceeding for compliance with injunction", File No. 108188/12, by the Judge in charge of Federal Court No. 2, Secretariat No. 4 of the City of La Plata, Dr. Adolfo Gabino Ziulu, whereby he ordered the appointment of an expert overseer (perito interventor) specialized in economic sciences to: (i) verify whether or not the invoices corresponding to the basic cable television subscription issued by the Company to subscribers domiciled in the Province of Buenos Aires, are actually prepared at the headquarters located at Gral. Hornos 690, and/or at the Company's branch offices, precisely detailing that process, (ii) identify the individuals responsible for that area, (iii) determine whether or not the administrative actions tending towards the effective compliance with the injunction issued on that case are underway, and (iv) identify the hierarchical personnel of the Company that must order the invoice issuance area to prepare the invoices as decided under that injunction.
[The Company] notes that [at the time], the Company duly appealed the injunction issued in the abovementioned case, given that Resolution No. 50/10 issued by Mr. [Guillermo] Moreno [Secretary of Domestic Trade] and its extensions or amendments are suspended with respect to the Company, its branches and Subsidiaries, by an injunction that predates the injunction issued in re: "Ombudsman (Defensor del Pueblo) v. Cablevisión S.A. re/ collateral proceeding for compliance with injunction", as provided under the collective injunction issued by the Federal Courts of Mar del Plata on 1 August 2011 in re: "La Capital Cable and others v. National Government and Others re/ Injunction". [This earlier injunction] declared the suspension of the application of all guidelines imposed by the Secretariat of Domestic Trade under Mr. Guillermo Moreno.
As of the date of this letter, the direct appeal filed by the Company before the National Supreme Court is pending resolution.
[The Company] will keep the Commission informed of any relevant event in connection with this case.
Sincerely,
