Report 28/2010: Bank shareholders filing appeal

The Management Board of Bank Polska Kasa Opieki S.A. ("Bank") hereby informs that on 7 April 2010 the Bank was serviced upon a appeal of a Bank shareholder concerning the verdict of the District Court of Warsaw, 20th Business Division of 28 January 2010, dismissing the shareholder's claim to repeal resolutions No 4, 5, 6, 7, 11, 12, 13, 14, 15, 16, 17, 18, 19, 21, 22, 23, 24, 25, 26, 27, 28, 29, 32 and 33 of Ordinary General Meeting of the Bank dated April 23, 2008 concerning approval for the report on the activity of the Management Board for 2007, approval for the financial statements of Bank and Bank Pekao S.A. Capital Group for 2007, approval for the report on the activity of the Supervisory Board in 2007, vote of approval for the members of the Management and Supervisory Boards for 2007.

In the Bank's opinion the shareholder's appeal is groundless.

Legal basis: § 38 section 1 point 6 of the Finance Minister's Ordinance of 19 February 2009 re. current and periodic reports published by the issuers of securities and the rules of equal treatment of the information required by the laws of non-member states.
