DataTern Inc., Receives Favourable Appeal Ruling
London and New York, 14 April 2014 - DataTern Inc., a wholly-owned subsidiary of Amphion Innovations plc (AIM: AMP) ("Amphion" or "the Company"), has received a favourable decision on its appeal to the US Court of Appeals for the Federal Circuit. The appeal was a result of the ruling that was rendered in December 2012 by the US District Court for the Southern District of New York in the declaratory judgment actions brought by SAP and Microsoft in April 2011.
As previously announced in Amphion's RNS announcement of 17 April 2013, DataTern's appeal was based on its belief that the New York court lacked jurisdiction and that the Markman claim construction rendered on DataTern's patents was flawed.
The Federal Circuit's decision broadly found in favour of DataTern's position.
Richard Morgan, CEO of Amphion, said; "This is a good result. This ruling will allow us to continue to try to reach equitable licensing agreements with the many companies that are infringing these patents. Our goal remains to generate a fair and reasonable return on the very substantial investment we have made over many years in the development of these innovative technologies."
