Adjournment of Jersey Proceedings

The Company refers to its announcement on 12 September 2016 in relation to the results of the Extraordinary General Meeting ("EGM") convened on 12 September. The Jersey Royal Court judge has decided that the trial date of 20 September is vacated and the trial adjourned.

The Court will sit on 26 September 2016. It was envisaged that this would be to hear the Company's application to discontinue. However, Mr Teh Kim Seng ("Mr Teh") wishes to raise certain points as to the validity of the EGM resolutions. The judge has ordered Mourant Ozannes ("MO"), Mr Teh's solicitor to issue a summons specifying exactly what relief they are seeking, accompanied by an affidavit(s) setting out fully the facts and grounds relied on in support of the summons plus a skeleton argument with any relevant authorities. MO must file these documents by close of business on Monday 19 September 2016. Any other parties wishing to oppose the summons must file the documents by close of business on Thursday, 22 September 2016. If MO fail to issue their summons by Monday 19 September, the judge will hear any application to bring forward the application of the Company to discontinue.
