LONDON (Alliance News) - Shire PLC said Wednesday that the US Supreme Court has granted its petition in its patent case against Watson, now Actavis PLC, regarding Lialda. The grant of this petition means that the case will be remanded back to the Federal Circuit for further consideration.
Lialda is used to treat ulcerative colitis, proctitis and proctosigmoiditis.
Shire had previously won a patent litigation against the company in 2013, but on an appeal the Federal Circuit reversed the District Court's claim construction, Shire said.
Shire said it was pleased with the Supreme Court's recent action, and that it substantiates its continued confidence in its patent position.
