Nanoco has IP infringement trial against Samsung set for October

(Alliance News) - Nanoco Group PLC on Monday said the trial into the alleged wilful infringement of its intellectual property by various Samsung Group entities has been set for October 2021.

The Manchester-based quantum dots developer filed a patent infringement lawsuit against several Samsung entities in the United States District Court for the Eastern District of Texas last month.

On Friday, Nanoco attended a claim construction hearing, also known as a Markman hearing, where the court was asked to construe the meanings of five different words or terms used in the patents that Nanoco alleges Samsung has infringed.

Nanoco said the judge's final written report on the Markman hearing is expected before the end of May.

Additionally, in May the US Patent Trial & Appeal Board is expected to rule whether or not it will grant Samsung's request to institute 'inter partes reviews' of the five patents in the case, which can take 12 months once instituted. Nanoco said it needs to win both the IPRs and the trial later this year to succeed in the case.

"Our lawsuit against Samsung for the alleged wilful infringement of Nanoco's IP is progressing well, and we are pleased that a trial date has been set for October 2021. We are also pleased with the initial indications arising from last week's hearing and will review the final written report when it is received. Although there can be no certainty as to the outcome, the Samsung litigation could result in a very substantial settlement in our favour," said Chief Executive Brian Tenner.

Shares in Nanoco were 3.3% at 22.20 pence in London on Monday.
